製作釣魚網頁騙取帳號密碼的行為，已觸犯刑法第362條「妨害電腦使用罪」：製作專供妨害電腦使用的電腦程式來犯案，致生損害者，處5年以下有期徒刑、拘役或併科20萬元以下罰金。
